Warranty Deeds
Warranty Deed
Most commonly used Deed to transfer real estate property ownership.
General Warranty Deed
Unlimited title warranties both express and implied.
Special Warranty Deed
Limited title warranties. Seller only guarantees they have not caused any title issues during their ownership.
Gift Deed
A Warranty Deed where nothing is given for the Deed. Often used to transfer property to a family member.
Deed Without Warranty
Transfers property without any title warranties, express or implied.
Estate Planning Deeds and Documents
Right of Survivorship
Created by a Survivorship Agreement. When a co-owner dies, the surviving co-owner receives the deceased owner’s interest in the property without probate.
Life Estate Deed
Transfers future ownership of a property to a person referred to as the Remainderman. The current owner becomes a Life Tenant
Lady Bird Deed
Also known as an Enhanced Life Estate Deed. The Life Tenant retains the right to sell or mortgage the property until their death
Transfer on Death Deed
Designates the person(s) to receive a property upon the owner’s death.
Trust for Real Estate
Trust to own real estate and other assets for the benefit of your spouse, children and grandchildren.
Additional Deeds and Documents
Affidavit of Heirship
Identifies the heirs of a deceased property owner who died with or without a Will.
Executor’s Deed
Transfers property from the estate of a deceased property owner to the heir(s) designated in their Will. Requires a probated Will and Letters Testamentary.
Deed in Lieu of Foreclosure
Transfers property to the lender without foreclosure. Lender must agree to accept.
Seller Financing
Documents include a Deed of Trust, a Promissory Note and a Warranty Deed.
LLC For Real Estate
Formation of a Limited Liability Company to own real estate. Often used for rental property.
Deed Transfer After Death
Documents which may be needed to transfer property after an owner has died without a Will or other Estate Planning document in place.
Quit Claim Deed
Give up or relinquish any claims or interest in a property. Does NOT transfer title in Texas.
